Applies to: the Holy Heroes mobile application for iOS and Android (com.holyheroes.app) and the app experience at app.holyheroes.com (together, the "App").

These Terms are an agreement between you and Holy Heroes[, LLC: confirm legal entity name] ("Holy Heroes," "we," "us"). By creating an account or using the App you accept them. Our [Privacy Policy: link on publication] explains how we handle your information and is part of these Terms.

1. Eligibility and accounts

You must have reached the age of majority in your place of residence to create an account. The App is designed for family use: the account belongs to the adult account holder, who is responsible for the household's use of the App, including any use by children in their care. You are responsible for keeping your sign-in credentials secure and for all activity under your account. Provide accurate account information and keep it current.

2. Subscriptions and billing

•     Parts of the App require a paid subscription ("Holy Heroes Plus"). Prices, durations, and included content are shown in the App before you buy.

•     Subscriptions are purchased through, and billed by, Apple's App Store or Google Play, not by us. Payment is charged to your store account at confirmation of purchase.

•     Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel anytime in your device's subscription settings (App Store: Settings → [your name] → Subscriptions; Google Play: Play Store → Payments & subscriptions). Deleting the App or your Holy Heroes account does not cancel a subscription.

•     Refunds are handled by Apple or Google under their policies; we cannot issue refunds for store-billed purchases directly.

•     If we change subscription pricing, the change applies no earlier than your next renewal, with any notice and consent the platform requires.

•     Use "Restore Purchases" in the App to re-establish an active subscription on a new device.

3. License to use the App and content

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App and to stream the audio, artwork, and other content (and, where the feature is offered, temporarily store it for offline playback within the App), for personal, non-commercial use by your household.

All content and software are owned by Holy Heroes or its licensors and protected by copyright and other laws. You may not copy, record, redistribute, publicly perform, sell, or make derivative works from the content; extract content from the App; or circumvent any content protection. Offline content remains subject to these Terms and may become unavailable if your subscription ends or the content is removed from our catalog.

4. Acceptable use

You agree not to: use the App unlawfully; probe, disrupt, or overload our systems; attempt to access other users' data; reverse engineer the App except where the law permits; use automated means to scrape or download content; or resell or commercially exploit the App.

5. Your submissions

Information you enter into the App (for example, playlists and preferences) remains yours; you grant us the license needed to operate the features that use it, as described in the Privacy Policy.

6. Changes to the App and catalog

Our content catalog changes over time; specific titles may be added or removed, including from an active subscription period. We may update, modify, or discontinue features of the App. If we discontinue the App entirely or materially reduce a paid subscription's core value, we will provide reasonable notice.

7. Termination

You may stop using the App or delete your account at any time ([Settings → Account → Delete account: confirm once shipped]). We may suspend or terminate your access if you materially breach these Terms, with notice where practicable. On termination your license ends and your data is deleted as described in the Privacy Policy. Sections 3 (ownership), 8–11 survive termination.

8. Disclaimers

The App is provided "as is" and "as available." To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.

9. Limitation of liability

To the fullest extent permitted by law, Holy Heroes will not be liable for indirect, incidental, special, consequential, or punitive damages, and our total liability for any claim relating to the App is limited to the greater of the amounts you paid for the App in the twelve months before the claim and US $50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you; nothing in these Terms limits liability that cannot lawfully be limited or affects statutory consumer rights.

10. Indemnification

You will indemnify Holy Heroes against claims arising from your violation of these Terms or misuse of the App, to the extent permitted by law.

11. Governing law and disputes

These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in North Carolina, and you and we consent to their jurisdiction, except where the law of your country of residence gives you the right to other venues or protections.

12. Apple-specific terms (iOS users)

•     These Terms are between you and Holy Heroes only, not Apple. Apple has no obligation to furnish maintenance or support for the App and is not responsible for it.

•     The license in §3 is limited to use of the App on Apple-branded products you own or control, as permitted by the App Store Terms of Service (including Family Sharing where enabled).

•     In case of the App's failure to conform to a warranty, you may notify Apple and Apple will refund the purchase price (if any); Apple has no other warranty obligation.

•     Apple is not responsible for addressing claims relating to the App, including product liability, regulatory non-compliance, or consumer-protection claims, or third-party IP claims.

•     You represent that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and are not on any U.S. Government restricted-parties list.

•     Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Google Play terms (Android users)

Your download and use of the App from Google Play is also subject to the Google Play Terms of Service. These Terms are between you and Holy Heroes only; Google is not responsible for the App and is a third-party beneficiary only to the extent Google Play's terms provide.

14. Changes to these Terms

We may update these Terms; the current version is always available in the App and at [URL]. For material changes we will give notice in the App or by email before they take effect. Continued use after the effective date constitutes acceptance.

15. Miscellaneous

If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger or sale. These Terms and the Privacy Policy are the entire agreement between you and us regarding the App.
